The Delivered driver application, operated by Signature Auto Group

These Terms of Service (“Terms”) govern your access to and use of the Delivered mobile application (the “App”), operated by Signature Auto Group (“Signature Auto,” “we,” “us,” or “our”). By signing in to or using the App, you agree to these Terms. If you do not agree, do not use the App.

Who this App is for. Delivered is a private, work-related tool provided solely to Signature Auto’s authorized drivers, employees, and contractors for coordinating and completing vehicle deliveries, pickups, trade-in and lease-return handling, and related logistics. It is not offered to the general public.

1. Eligibility and Authorized Use

You may use the App only if you are an authorized driver, employee, or contractor of Signature Auto and have been granted access.
You may use the App only for legitimate Signature Auto business purposes and in accordance with any instructions, policies, or agreements between you and Signature Auto.
Access may be granted, limited, suspended, or revoked at our discretion at any time.

2. Your Account and Credentials

You are responsible for keeping your sign-in credentials (such as your name, PIN, and device biometrics) confidential and for all activity that occurs under your account.
Do not share your credentials or allow others to use the App under your identity.
Notify Signature Auto promptly if you believe your account has been compromised or your device is lost or stolen.

3. Acceptable Use and Safety

Drive safely and lawfully. Do not interact with the App in a way that distracts you while operating a vehicle. Obey all traffic laws and pull over safely before using features that require your attention.
Enter accurate, truthful information — including job status, photos, videos, paperwork, and payment details — and do not falsify records.
Do not misuse the App, attempt to bypass security, access data you are not authorized to access, reverse engineer it, or use it to harm Signature Auto, customers, or others.
Use the App only on devices and networks you are permitted to use for work.

4. Location and Device Permissions

The App uses your device’s location, camera, and other features while you perform assigned jobs, as described in our Privacy Policy. By using the App, you acknowledge and consent to that collection and use. Location is used only during an active delivery and stops when the job is complete.

5. Company Data and Ownership

All job, delivery, vehicle, customer, and business information created or accessed through the App is the property of Signature Auto and/or its clients, and must be handled in accordance with our policies.
The App, its content, and all related intellectual property are owned by Signature Auto or its licensors. These Terms do not grant you any ownership rights in the App.
You may not copy, export, or disclose company or customer data except as required to perform your authorized work.

6. Confidentiality

Information you access through the App — including customer details, vehicle information, pricing, and delivery records — is confidential. You agree to protect it and not to disclose or use it outside the scope of your authorized work.

7. Third-Party Services

The App relies on third-party services, including Google Maps Platform and, for navigation, Google Maps and Waze. Your use of those services is also subject to their applicable terms and policies, including the Google Terms of Service and Google Maps Platform Terms. We are not responsible for third-party services.

8. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose, availability, accuracy of maps, routes, or ETAs, or uninterrupted operation. You are responsible for exercising your own judgment while driving and performing deliveries.

9. Limitation of Liability

To the fullest extent permitted by law, Signature Auto and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the App. Nothing in these Terms limits any rights or obligations under your employment or contractor relationship with Signature Auto or that cannot be limited under applicable law.

10. Suspension and Termination

We may suspend or terminate your access to the App at any time, with or without notice, including if you violate these Terms or your access is no longer required. Upon termination, you must stop using the App. Provisions that by their nature should survive termination will survive.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide notice within the App. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in New York, to the extent permitted by law.
